Trial Date Set for Newsom Administration to Explain Prohibition of Indoor Fitness CA Only State Without Fitness Open Indoors Sacramento, Calif. Feb. 4, 2021 The California Fitness Alliance (CFA) moves closer to a trial date with the Newsom Administration. Wednesday the Los Angeles County Superior Court Judge Mark Mooney rejected State efforts to delay and set a trial date for June 7, 2021. Meanwhile, the Newsom Administration continues to bend the rules subjectively, as ev...idenced by a January 26 directive allowing one-on-one personal training indoors in purple tier counties. Our legal fight is about transparency, accountability and ensuring that clean, safe businesses who are providing jobs and essential services to Californians can have the opportunity to do so, Scott J. Street, CFA Attorney and Partner with Musick Peeler & Garrett LLP said. The State claims it is safe to workout indoors for someone who can afford a personal trainer, but not for people who belong to a professional fitness club. We’ve provided data that demonstrates we are safe too, yet without justification, the Governor continues to keep us closed, hurting our members, threatening our employees and risking our businesses. This is not a California for All. It is a California for those who can afford it. California is the only state in the country that is not allowing access to fitness during the coronavirus pandemic. CFA believes the government should look at data and science and to stop preventing Californians from having reasonable and safe access to indoor fitness centers and the proven benefits, including maximizing their resilience to COVID-19, exercise provides to their physical and mental health. We are fighting for fair and equitable access to fitness for all Californians, said the CFA Advisory Board. We continue to be frustrated with Governor Newsom’s unwillingness to justify his decisions by releasing the data they are using to make decisions that affect people’s lives and livelihoods. CFA lawyers will be back in court on March 11 seeking an order to compel the former director of California’s public health department, Dr. Sonia Angell and Governor’s Office officials to appear for depositions.
