Unfortunately, I am not ready to move on to a Non-Provisional application. However, I am making additions to the original design so can I start a new Provisional App since there are changes to the product? ADLI Answer: Yes, you can start a new provisional application. The new application will be entitled to a new priority date, whic...h will be the new filing date. However, if you have publicly disclosed the invention since filing the provisional, you only have a year from the disclosure date to file the new provisional to preserve your rights in the U.S. Your international rights, however, would be mostly lost if there was such a public disclosure and you start with a new application. Adli Advises: Can the title of a patent be changed or modified after submitting the application to the USPTO? If yes, what's the procedure? If I filed an NPA (non-provisional patent application) but want to change the patent title/name right after. Are there any options for me? What's the procedure? Adli's Answer: Yes, you can change the title of the invention all the way to right before issue. Indeed you can change any part of your application, including not just the title,... but the other parts of the written specification, the drawings and even the claims. the only prohibition on any change after filing an original application, whether provisional or not, is that you can’t add "new matter. New matter is not exactly defined but it is generally content that is outside the scope of the invention described and claimed in the original application. Keep in mind that this does not mean that you can’t change, delete or add content to the original application. The standard for understanding a patent application is how a person of ordinary skill in the field of the invention views it. When the patent examiner or a court sets on the task of determining what the claims (which define the invention(s)) mean, they try to put themselves in the shoes of that hypothetical person of ordinary skill.
